Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Digital Divas LLC ("Digital Divas," "we," "us") governing your access to and use of digitaldivas.ai (the "Site") and any products, characters, memberships, or services you purchase from us (collectively, the "Services"). By using the Site or buying from us, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. By using the Site you represent that you meet these requirements and that the information you provide is accurate.

2. What we sell

We sell AI-generated digital characters ("AI influencers") and related services. This includes ready-made premade characters, custom characters designed to your brief, optional private content-generation setups, and community memberships. Product descriptions, pricing, and availability shown at checkout are controlling. Because premade characters are one-of-one, a character is removed from sale once purchased.

3. Orders, payment, and checkout

Checkout and payment are processed by our commerce provider (WooCommerce) on our store. We do not store your full payment-card details. All prices are in U.S. dollars unless stated otherwise. We may refuse or cancel an order — for example, if a product was mispriced or is unavailable — and will refund any amount charged for a cancelled order.

4. Memberships and subscriptions

Memberships are recurring subscriptions that renew automatically at the interval and price shown at checkout until cancelled. You may cancel at any time through your account or by contacting us; cancellation stops future renewals and does not retroactively refund a paid period unless required by law. Memberships are optional and are not required to create content.

5. Ownership and license of characters

When you purchase a character, you receive the rights described at the time of sale to use that character and the content you generate with it. You are responsible for how you use your character and the content you create. Digital Divas retains ownership of the Site, our platform, our software, and our own brand assets, and nothing in these Terms transfers those to you.

6. Acceptable use

You agree not to use the Services to create, publish, or distribute content that:

• depicts or implies any real, identifiable person without their consent;
• depicts minors, or is designed to appear to depict minors, in any context;
• is unlawful, defamatory, harassing, or infringes another party's intellectual-property or privacy rights;
• misrepresents AI-generated content as real in a way that is deceptive or unlawful; or
• violates the rules of any third-party platform on which you publish.

You are solely responsible for complying with all laws and third-party platform policies that apply to how and where you distribute content made with your character. We may suspend or terminate access for violations of this section.

7. AI-generated content disclaimer

Our characters and outputs are artificial and computer-generated. They do not depict real people, and any resemblance to a real person is unintentional. AI generation can produce unexpected or imperfect results; the Services are provided for creative use and we do not guarantee any particular output, outcome, audience, or result.

8. Refunds

Refund eligibility for digital goods and services is described at checkout and in any separate refund policy we publish. Because characters and generated content are digital and delivered promptly, some purchases may be non-refundable once fulfilment has begun. 9. Disclaimers and limitation of liability

The Services are provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, Digital Divas will not be liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to the Services will not exceed the amount you paid us for the item giving rise to the claim.

10. Changes to these Terms

We may update these Terms from time to time. The "Effective" date above reflects the current version, and your continued use of the Services after an update constitutes acceptance of the revised Terms.
